These Terms and Conditions (“Terms”) govern your use of the services offered by Aeroplai (operated by YCA Aeroservices Pvt Ltd), including but not limited to paramotoring services, booking systems, and any other activities provided by Aeroplai. By accessing and using the services, you agree to comply with and be bound by these Terms. Please read them carefully before using any services provided by Aeroplai.

1. General Terms

By using our website or services, you agree to:

  • Follow all terms laid out in this document.
  • Abide by any specific rules, guidelines, or regulations that apply to any service you utilize.
  • Use the services only for lawful purposes.

If you do not agree with any part of these Terms, you must refrain from using the services.

2. Booking and Payment Terms

  • Booking Confirmation: All bookings made via the Aeroplai website or other booking channels are subject to availability and confirmation. Once you make a booking and complete the payment, you will receive a confirmation via email or message.
  • Payment: Payments for services offered by Aeroplai are processed through secure payment gateways, including Razorpay. By making a booking, you authorize Aeroplai to process your payment.
  • Cancellation & Refund:
    • Cancellations made 24 hours before the scheduled activity may be eligible for a refund.
    • No refunds will be provided for cancellations made within 24 hours of the scheduled ride, or for no-shows.

3. Participant Eligibility

  • Age & Weight Restrictions: Participants must be within the following criteria:
    • Age: 15-60 years
    • Weight: 40-100 kg
  • Medical Conditions: You must disclose any pre-existing medical conditions that could affect your ability to participate in paramotoring or related activities. A medical certificate may be required to ensure you are fit to participate.
  • Consent and Liability Waiver: All participants must sign a consent form and liability waiver before engaging in any activity.

4. Indemnity Agreement

By participating in any activities organized by Aeroplai, you agree to indemnify, defend, and hold harmless YCA Aeroservices Pvt Ltd (and its affiliates, officers, directors, employees, agents, and representatives) from any and all claims, damages, liabilities, and expenses, including legal fees, arising from:

  • Your participation in paramotoring and other related activities.
  • Any injury, damage, or loss incurred by you or others during the activity.
  • Any violation of these Terms or applicable laws.

This Indemnity Agreement applies even if the injury or loss is caused by the negligence or misconduct of Aeroplai.

5. Liability and Limitations

  • Limitation of Liability: Aeroplai is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of the services or from any injury, damage, loss, or accident that occurs during paramotoring or other activities.
  • Release of Liability: By participating in Aeroplai activities, you release YCA Aeroservices Pvt Ltd, its employees, and contractors from any liability related to personal injury, loss of property, or any other consequences arising from your participation in paramotoring activities.

6. Safety and Security

  • Pre-Flight Safety Briefing: All participants are required to attend a mandatory safety briefing before the flight. This includes information on equipment, flight procedures, and emergency protocols.
  • Equipment: All paramotoring equipment is inspected before and after each flight to ensure it meets the highest safety standards. It is your responsibility to use all provided safety gear, including helmets and harnesses.
  • Security Measures:
    • Restricted Areas: Access to certain areas during the operation is restricted. Only authorized personnel are allowed in these areas to ensure safety.
    • Emergency Equipment: First aid kits, fire extinguishers, and emergency communication systems are available at all times.

7. Personal Data and Privacy

We value your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.

8. Use of Website and Services

You agree not to:

  • Engage in activities that may disrupt or damage the Aeroplai website, services, or the experience of other users.
  • Use the services for any unlawful purposes or fraudulent activity.
  • Violate any applicable laws while using our services.

9. Modification of Terms

Aeroplai reserves the right to modify, update, or change these Terms at any time without prior notice. It is your responsibility to review these Terms periodically. Your continued use of the website or services following any changes indicates your acceptance of those changes.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Solapur, Maharashtra.
